The Madhya Pradesh High Court has rejected the appeal for age to be given in a petition on a petition, an economically backward UPSC candidates.

This petition was filed by 16 other people, including Aditya Narayan Pandey of Maihar of Madhya Pradesh, demanding concession for EWS candidates.

Court said- no provision for exemption for EWS

The court also dismissed the claim of the petitioners, in which they were asked to exemption at the state list of OBCs (Other Backward Classes), but do not appear in the list of CSE-2024 and CSE-2025 exams in UPSC i.e. Union Public Service Commission.

A bench of Judge Suresh Kumar Kait and Justice Vivek Jain clarified that the exemption given to Scheduled Castes (SC), Scheduled Tribes (ST) and Other Backward Classes (OBC) cannot be given for EWS as there is no provision.

Exemption is available on the basis of articles 15 and 16

The court has rejected 17 petitions. Articles 15 and 16 of the Constitution are divided into social and economic categories. Under this, reservation is given in EWS only on economic basis and OBCs are exempted on social backwardness.

The bench said, the role of the judiciary in such cases is limited to assessing whether policy violates fundamental rights or constitutional provisions. Until there is hostile discrimination in the policy, the courts cannot make policy changes.

Along with this, the court also dismissed the petition to give nine attams to the state OBC candidates in the UPSC examination. As is allowed to central OBC candidates.
