1. Teachers continue to protest in Chhattisgarh, NCTE did not present its stand strongly in the court.

Protest of fired teachers continues in Chhattisgarh, but what was the reason why the government gave termination letters to 2897 appointed teachers? Due to which decision of the Supreme Court is there an uproar in Chhattisgarh?

In fact, due to vacant posts in primary schools, NCTE i.e. National Council for Teacher Education said in 2018 that now BEd people will also be eligible for primary classes i.e. classes up to 5th. Provided that they will have to do the bridge course of DElEd within two years. Earlier, only those with DElEd were eligible for primary education. Despite the new decision, in 2021 the Rajasthan government excluded BEd people from the criteria for recruitment of primary teachers. Some candidates reached Rajasthan High Court against this. Where the changes made by NCTE in 2018 were rejected and the verdict was given in favor of the Rajasthan government.

Supreme Court also raised questions on NCTE

After this the candidates reached the Supreme Court and there too questions were raised on NCTE. The Supreme Court said that NCTE should have formed a committee to make changes, which was not formed. On August 11, 2023, the Supreme Court while giving its verdict said, ‘B.ED as a qualification for primary school teachers. By including the Central Government, the Central Government has acted against the Constitution and the law. This is also against the Right to Education. In these circumstances we have no hesitation in saying that it should be cancelled.

However, a month before this i.e. on July 2, the merit list for the recruitment of primary teachers in Chhattisgarh had been released, in which BEd people were included. But after the Supreme Court’s decision, DElEd candidates reached Chhattisgarh High Court. High Court canceled the counseling of BEd people. After this, those with BEd reached the Supreme Court where they got interim relief. Meanwhile, the High Court has given its final verdict against those with BEd in April 2024. This time BEd people did not get any relief even from the Supreme Court. On December 10, 2024, the High Court asked the government to take action on this matter within two weeks. After this, the state government gave termination letters to the working teachers. The question here is why NCTE did not present its stand strongly in the court? And as per the suggestion of the High Court, why are the teachers who have got the job not being adjusted at the higher primary level?
