The RCB marketing head has been sent to judicial custody for 14 days.
The Karnataka High Court will hear the petition of RCB’s marketing head Nikhil Sosh today. Nikhil was arrested on 6 June in connection with the stampede near M Chinnaswamy Stadium.
Sosh’s petition has questioned the validity of his arrest. It was also alleged that the police action was affected by political instructions.
Nikhil’s lawyer told the court that the Central Crime Branch arrested him at the behest of CM Siddaramaiah. In the June 9 hearing, the court did not provide interim relief to Nikhil.
Justice SR Krishna Kumar said that a petition related to Nikhil Sosh will be heard separately at 10.30 am.
Question in the petition- Did the police had the right to arrest
Sosle’s lawyer Sandesh Chauta questioned in the court in June 9, whether the police officers had the right to arrest Sose. Nikhil was arrested by the Central Crime Branch (CCB), not by the police investigating the case.
Chauta alleged that the arrest was not for any investigation, but because the Chief Minister issued instructions. Citing DK Basu’s decision, Chauta said that he cannot pick up anyone without telling him. The rights of the victim were violated.
On June 5, the Karnataka government itself said in the court that the investigation has been handed over to the CID, it doubts the jurisdiction of the CCB. When the matter was handed over to CID, how did CCB come in the picture?
Government’s side- Was not sitting in restaurant, was at the airport
During the hearing, Justice Krishna asked if the Chief Minister had openly said that the arrests would be made, then the Advocate General said that he would have to check the record. Taking favor of the government, Shetty said that the officials were only doing their work. It is not that Nikhil was having lunch in a restaurant. They were going to the airport at 5 am, what should they do?
AG said- Sose had already been remanded, which did not require interim relief. Advocate General Sasikiran Shetty sought time to respond to the arguments.
Supreme Court’s Arnab Goswami case also mentioned
During the hearing, Justice Krishna cited a Supreme Court verdict in the Arnab Goswami case. Jajj said that if the Primesi Maurial is not present, interim bail can be granted. The judge said- “Forget the CID for a moment. The Kabban Park Police handed over the case to the Ashok Nagar Police, who then requested the CCB to arrest. The issue is that once the case was handed over to the CID, did anyone else have the right?”
