On 17 February 2020, a bench of Justice DY Chandrachud and Justice Ajay Rastogi gave a historic decision. In this decision, the Delhi High Court’s decision to give a permanent commission (PC) to women officers in the Indian Army was upheld and it also mentioned Lieutenant Colonel Sophia.
Hearing on writ petitions filed in 2003, 2006
Female officials and advocate Babita Punia filed writ petitions in the Delhi High Court in 2003 and 2006. The debate on a set of these petitions began in which permanent commission allotment demanded the post of Short Service Commission (SSC) officers to get the post.
Justice Chandrachud gave the example of Colonel Sophia during the verdict
This petition was about the permanent commission in the army. The bench of DY Chandrachud then described the discrimination on the gender basis as a complete injustice, giving the example of Colonel Sophia (then lieutenant).
The bench of Justice Chandrachud appreciated the contribution of women to the army and condemned the conservative beliefs made on women officers under gender, motherhood and battlefield conditions for the recruitment of a female officer in the central government.
Sophia was the leader of exercise force 18
The bench had said in its decision that Sophia Qureshi is the first female officer in the country to have been the leader of exercise forces 18 multinational military exercises. She has been part of the United Nations Peace Campaign.
Assuming that women cannot live in such a position, tells a prejudice and is constitutionally wrong. Along with this, the bench had said that women officials of the Indian Army have made the army proud.
Justice Chandrachud said- women are not disqualified
Along with this, Colonel Sophia has been in charge of monitoring ceasefire in those countries in the Congo in 2006 and helping human activities. Their work included ensuring peace in struggle affected areas. This is an example that women are not ineligible for command or difficult assignments. The court emphasized that refusal on the basis of gender would insult dignity.
